Nebraska voters resoundingly passed two medical marijuana initiatives on the ballot in Tuesday’s general election.

Nebraska voters passed two related ballot initiatives to legalize medical marijuana and regulate the industry in the state on Tuesday.

LINCOLN, Neb. (KLKN) — Two ballot initiatives allowing medical marijuana coasted to victory Tuesday night in Nebraska. One of the initiatives legalizes medical cannabis, while the other provides for its regulation. Initiative 437 had 71% of the vote as of 11:55 p.m., while Initiative 438 had 67%.

Despite those endorsements, medical marijuana could still be blocked in court. Although Nebraska Secretary of State Bob Evnen approved both initiatives for the ballot, a lawsuit by John Kuehn, a former Republican state senator,

Initiative Measure 437 would allow for people to carry and use up to five ounces of cannabis for medical purposes with the recommendation from a health care practitioner. If passed, Initiative Measure 438 would establish NE Medical Cannabis Commission to regulate medical marijuana.

Florida's effort to legalize adult-use marijuana failed to pass with a 60% super majority of votes needed. Voters in three other states will weigh in on the legalization of marijuana on Tuesday, as well.

Judge Susan Strong took the case under advisement Monday afternoon following closing arguments, hours after election workers began tabulating early ballots cast ahead of Tuesday's general election.
